Can I upload photos of cultural heritage/assets to Moodle?

Answer

Even for assets which do not fall under copyright (which should always be checked in the first place), there can be different situations.

  • Photos of cultural assets owned by or under the care of public institutions:
    • If the images are realized by own means, they can be freely uploaded “provided they are not used for further economic or commercial exploitation” (Codice dei Beni Culturali, art. 108, comma 3bis); [translation from the Italian by the Library Staff]
    • If the images belong to the public institution, you must get a license.
  • Photos of cultural assets owned by private or foreign institutions:
    • Each institution’s policy must be followed. Institutions might need to be contacted to get this information.
